Article 1: Scope and Modification of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) govern the contractual relationship between BEFORE DEADLINE S.L. (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Buyer”) for any purchase made through the website www.lestamponsderoser.com.

The Seller offers personalized ex libris and other similar products, intended for both personal and limited commercial use, as detailed in each product description.

The GTC are effective from the moment the Buyer confirms their order on the Website. BEFORE DEADLINE S.L. reserves the right to modify these GTC at any time, with the version in effect at the time of order confirmation by the Buyer being applicable.

Article 2: Product Information

BEFORE DEADLINE S.L. offers personalized ex libris and stamps, custom-made at the Buyer’s request or based on original designs available in the website catalog. Each product is presented with a detailed description, including materials, dimensions, and customization options.

Personalized products cannot be resold or modified once the Buyer has approved the final design. Any changes after approval may incur additional costs, depending on the progress of the ex libris creation.

In the unlikely event that a product is unavailable or there is an error in the description or price, the Seller reserves the right to cancel the order before shipment. In such a case, the Buyer will be immediately informed and fully refunded for the amount paid.

If a requested product is unavailable or cannot be manufactured due to technical or logistical reasons, the Buyer will be notified as soon as possible and will have the option to choose between an alternative product or a full refund of the amount paid.

The selection and customization of a product are the sole responsibility of the Buyer. The inability to use the product due to technical incompatibility or other reasons will not result in compensation or refund, except in cases where the Seller is at fault.

Article 2 bis: Gift Cards

BEFORE DEADLINE S.L. offers gift cards in two versions: standard and custom. The standard version allows the purchase of any model from the catalog available at the time of redemption, except for two-color ex libris. The custom version allows the purchase of an ex libris designed to the Buyer’s specifications by the Seller.

The gift card amount covers the price of an ex libris (according to the chosen version), one ink, and a provision for standard shipping costs applicable at the date of purchase. The gift card represents a redeemable balance on the website and does not guarantee the freezing of the product price or shipping costs. If these costs or the product price have increased at the time of redemption, the Buyer must pay the corresponding difference.

Purchase and Redemption Process

  1. Once the order is confirmed, the gift card code will be sent to the Buyer via email within a maximum of 24 hours.
  2. The gift card can be used on the website www.lestamponsderoser.com by entering the corresponding code during the payment process.
  3. It has no expiration date and can be used at any time.
  4. The gift card is not redeemable for cash or refundable, except as provided by consumer protection laws.
  5. In case of code loss, the Buyer may request a reissue by contacting customer service at hello@lestamponsderoser.com, subject to identity verification.

Data Protection and Security

Personal data provided for purchasing the gift card will be processed in accordance with Organic Law 3/2018 on Personal Data Protection and the General Data Protection Regulation (GDPR). Data will only be used for the issuance and management of the gift card and will not be shared with third parties, except for payment and shipping service fulfillment.

The Buyer may exercise their rights of access, rectification, deletion, and objection regarding their personal data by sending an email to hello@lestamponsderoser.com.

Fraud and Misuse

BEFORE DEADLINE S.L. reserves the right to cancel any gift card if fraud, misuse, or non-compliance with these conditions is detected. If there is any doubt about a card’s validity, the Buyer may contact customer service.

Article 3: Prices

The prices of the products are expressed in euros (€) and include the applicable Value Added Tax (VAT) in accordance with Spanish regulations.

The prices include the applicable VAT at the time of purchase. Any changes in legislation affecting applicable rates or taxes will be reflected in the final price before the Buyer confirms their order.

Prices do not include shipping costs, unless otherwise stated during the purchasing process. These shipping costs will be calculated and detailed based on the Buyer’s location and the selected shipping method.

BEFORE DEADLINE S.L. reserves the right to modify prices at any time; however, the prices in effect at the time of order confirmation will apply.

If a typographical error is detected in the product prices, the Seller will notify the Buyer, who will then decide whether to continue with the order at the corrected rate or to cancel it.

Article 4: Payment Conditions

Payment for the order can be made via credit/debit card, bank transfer, or electronic payment platforms such as PayPal.

All payments are processed through secure payment gateways, using SSL security protocols to ensure the confidentiality of the Buyer’s data. At no time will BEFORE DEADLINE S.L. have access to the Buyer’s banking information.

The Seller reserves the right to withhold shipment of the order until full payment is confirmed.

In the event of non-payment or payment delays, the Seller reserves the right to cancel the order and not proceed with delivery.

In cases of non-payment, collection agencies may be contracted, along with any resulting legal and administrative consequences. All additional costs arising from the recovery process will be borne by the Buyer.

Article 5: Customization of Products

Since most products offered by BEFORE DEADLINE S.L. are customized, once the design is approved by the Buyer, changes or returns will not be accepted, except in cases of error by the Seller or manufacturing defects.

The customization process will include sending a sketch or digital proof of the design to the Buyer for approval. It is the Buyer’s responsibility to carefully review and approve the design. The Buyer has two opportunities to request modifications to the design, with a maximum limit of three different versions. Beyond these opportunities, any additional modification requests may be rejected or incur additional costs at the Seller’s discretion. The Buyer is encouraged to validate each stage of customization within the established timelines. Any delay in validation may result in an extension of manufacturing and shipping times, for which the Seller cannot be held responsible. The final product’s manufacturing will not begin without the Buyer’s final approval.

The manufacturing times for customizable catalog models are generally 5 business days (excluding weekends and public holidays). The total delivery timeframe will then depend on the selected shipping method and destination country. The indicative timeframes displayed on the product pages at the time the order is placed shall prevail. The creation and manufacturing times for custom-made models vary according to the option chosen by the Buyer: up to 30 days for the standard option and up to 7 days for the express option. These times may be adjusted based on the Seller’s workload or special circumstances, such as holidays or vacation periods.

On the website, reference times will be updated directly on the product pages, ensuring that the Buyer has up-to-date information at the time of purchase. Additionally, any changes in timelines will be communicated through a visible banner at the top of the website, providing general information about the changes.

During special periods, such as holidays or festive seasons, clear and specific information about timeline management will be provided either in a FAQ section or on the product pages. In the event of a significant extension of the announced timeframes, the Buyer will be informed in advance and will have the right to cancel the order and receive a full refund.

Article 6: Delivery

Products will be delivered to the address provided by the Buyer during the purchasing process. Delivery times will vary based on the Buyer’s location and the type of product requested.

Estimated delivery timeframes are provided for information purposes on the product pages and at the time the order is placed. They vary depending on the type of product, the destination country, and the selected shipping method. The timeframes displayed are estimates that include preparation, manufacturing, and transportation of the parcel. The indicated timeframes are estimates only and may be affected by exceptional circumstances, periods of high demand, public holidays, or delays attributable to carriers.

In the event that the Buyer is not present at the time of delivery, it will be the Buyer’s responsibility to pick up the package at the post office or to arrange a new delivery with the carrier. If the package is returned to the Seller due to the Buyer’s absence, the costs of reshipping will be borne by the Buyer.

The Seller will not be responsible for delays in delivery caused by force majeure or actions by third parties, such as strikes or natural disasters. However, the Seller is committed to keeping the Buyer informed of any incidents that may affect shipping.

The Seller will be responsible for ensuring the delivery of the order to the Buyer within the established timeframes, except in situations of force majeure or cases where the failure to comply is attributable to the Buyer (for example, by providing incorrect information). In the event that a delivery delay is caused by the carrier, the Seller will make every effort to manage the claim, but will maintain responsibility to the Buyer until the product is delivered. The Seller can be relieved of liability when it is demonstrated that the failure to comply or improper execution of the contract is attributable to the Buyer or to an unforeseeable and insurmountable event by a third party unrelated to the contract, provided that it is not the carrier chosen by the Seller.

In the case of errors in the contact information provided by the Buyer, the Seller will not be responsible for the non-delivery of the order. In this case, if the order needs to be resent, the cost of the new shipment will be borne by the Buyer, charged at the actual price. Delivery will be considered “completed” at the moment the package is made available to the Buyer at the address indicated in the order. The risk of loss or damage to the products transfers to the Buyer when the Buyer or a third party designated by them, who is not the carrier, physically takes possession of the goods.

If the Buyer detects a visible defect or has any doubts about the integrity of the package, they are advised to check the contents in the presence of the carrier. If the package is damaged or its contents are not in good condition, the Buyer must issue written reservations, signed by both parties (the Buyer and the carrier). Any claims against the carrier must be made within 10 business days following receipt of the package. However, the Seller will be liable to the Buyer in the case of receiving a damaged product and will handle the claim with the carrier.

In the event of non-delivery of the order, or part of the order, the Buyer is encouraged to contact the Seller as soon as possible so that an investigation can be opened with the carrier.

Article 7: Right of Withdrawal and Returns

In accordance with Article 103 of the General Law for the Defense of Consumers and Users, the right of withdrawal will not apply to personalized products, as they are created according to the specifications indicated by the Buyer and are not suitable for return.

However, in the event of an error in the personalization of the ex libris by BEFORE DEADLINE S.L. or manufacturing defects, the Buyer must notify the Seller within 48 hours of receiving the order, providing photographic evidence of the defect or error.

If the Seller confirms the defect or error, the defective product will be replaced at no additional cost to the Buyer, or, if applicable, a refund of the amount paid will be processed within 14 business days following the resolution of the incident.

In the case of defective or damaged products during transport, the Buyer must notify the Seller within 48 hours of receiving the order, providing evidence (photographs of the damage). The Seller will cover the return costs and send a replacement product at no additional cost.

Article 8: Warranty

The products sold through BEFORE DEADLINE S.L. are covered by the legal conformity warranty according to Royal Legislative Decree 1/2007, of November 16.

The Buyer has the right to the repair or replacement of defective products at no cost, provided that the lack of conformity is communicated within 2 years following delivery.

The warranty does not cover normal wear and tear of the product, nor damage caused by improper use or negligence on the part of the Buyer.

Article 9: Intellectual Property

All designs, texts, graphics, logos, images, and software included on the Site are the exclusive property of BEFORE DEADLINE S.L. and are protected by European intellectual property and copyright laws.

The created ex libris that include the name of the owner of the object, whether made to order or based on designs from the catalog, may be displayed online or physically only with the prior and explicit consent of the Buyer. However, the Seller reserves the right to use images of the personalized ex libris for promotional purposes, provided that elements that may identify the Buyer, such as their name, are modified and the confidentiality of personal data is respected. If the Buyer wishes to oppose the use of images of their personalized design, they may communicate this to the Seller at any time.

The Buyer does not have reproduction or distribution rights for the personalized design they have acquired, except for personal use, and any commercial use is prohibited without the explicit consent of the Seller.

Article 10: Protection of Personal Data

In compliance with Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD) and the General Data Protection Regulation (GDPR), BEFORE DEADLINE S.L. is committed to ensuring the privacy and protection of the personal data provided by the Buyer.

Personal data will be used exclusively for order management, product personalization, and improving the services offered. Under no circumstances will they be transferred to third parties, except for the fulfillment of the delivery service.

The Buyer has the right to access, rectify, delete, or limit the processing of their personal data, as well as to oppose its processing for commercial purposes, by sending a request to hello@lestamponsderoser.com.

In some cases, the Seller may outsource data processing to external service providers (e.g., hosting services, payment gateways), always ensuring that they comply with current data protection regulations.

Article 11: Applicable Law and Jurisdiction

These General Terms and Conditions (GTC) are governed by Spanish law. Any dispute arising between the Buyer and the Seller shall be submitted to the courts of Barcelona.

If any provision of the GTC is declared null or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
